Licensing Agreement for PlantFCE by Storm Consulting

Effective Date: 27 November 2024

This Licensing Agreement (“Agreement”) is a binding agreement between you (“User,” “you,” or “your”) and Storm Consulting (“we,” “us,” or “our”) regarding your use of the suite of PlantFCE applications (“App”). By downloading, installing, or using the App, you agree to abide by this Agreement.

1. License Grant

Storm Consulting grants you a limited, non-exclusive, non-transferable, revocable license to install and use the PlantFCE suite of applications solely for personal or business purposes in accordance with this Agreement and our Terms of Service.

• Individual License: For individual use only; cannot be shared.
• Business License: For commercial or business use. Each business license allows a single user and installation, unless stated otherwise in a specific agreement or bulk licensing arrangement.

2. Scope of License

This license is for the authorized use of the App and does not grant you any ownership of or title to the App or its content. All rights, title, and interest in and to the App remain with Storm Consulting.

3. License Restrictions

You agree not to:

• Modify, Copy, or Reverse Engineer: You may not modify, copy, decompile, or reverse engineer the App or attempt to derive its source code, except to the extent allowed by law.
• Transfer or Sub-license: You may not rent, lease, lend, sell, redistribute, or sub-license the App to others without prior written consent.
• Use for Unauthorized Purposes: You may not use the App for any unlawful or prohibited purposes or in ways that violate this Agreement.

4. Updates and Upgrades

We may periodically provide updates or upgrades to the App, which may be necessary for optimal use or compliance with applicable laws. Any updates provided will be part of the App and subject to this Agreement.

5. Termination

This license is effective until terminated. We may terminate your license immediately, without notice, if you fail to comply with this Agreement. Upon termination, you must cease all use of the App and delete all copies from your devices.

6. Limited Warranty

The App is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the App will be error-free or uninterrupted. Your use of the App is at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, Storm Consulting shall not be liable for any damages, including incidental or consequential damages, arising from your use of the App or inability to use the App.

8. Governing Law

This Agreement is governed by the laws of India, without regard to its conflict of law principles. Any disputes arising under or in connection with this Agreement shall be resolved through arbitration in Mumbai, India.
